The Winter Olympics 2023-2024 Terms and Conditions

The Freedom Forever Winter Olympics (“Contest”) is a sales competition hosted by Freedom Forever LLC (the “Host”). By submitting your entries through Freedom Forever’s mobile app, “VOLT”, you acknowledge that you have read, reviewed, accepted, and agreed to be bound by these Terms and Conditions, VOLT’s privacy policy and terms and conditions (viewable in the VOLT app), and by the Host’s decisions, which are final and binding. You also confirm that you are (i) either an employee of Freedom Forever or a contracted sales representative of an independent authorized dealer of Freedom Forever (the “Sales Representative(s)”), (ii) are at least eighteen (18) years old, and (iii) live within the United States. This Contest is subject to federal, state, municipal, and local laws and regulations and is void where prohibited or restricted by law. Your participation in this Contest is voluntary. Winning a prize is contingent upon fulfilling all requirements set forth herein.

THE CONTEST AND TEAMS. The Host is hosting the following Contest, commencing on December 20, 2023 through February 10, 2024 (the “Contest Period”). The Contest will comprise of one big competitionwhere Freedom Forever branch locations will team up to form sixteen (16) teams (individually a “Team” and collectively, the “Teams”) and compete against one another for the grand prize and other prizes.

The 16 Teams for the Freedom Forever Winter Olympics are as follows:

1. North Shore, MA; Long Island; and Northern Cheyenne (NCT)

2. Inland Empire; Richmond; and Salt Lake City

3. Orlando; Greenville; and Jacksonville

4. South Houston; Raleigh; and Little Rock

5. Las Vegas; El Paso; and Albuquerque

6. North Phoenix; Charleston; and Columbus

7. Sacramento; Reno; and San Antonio

8. Maryland; Ft Lauderdale; and Atlanta

9. Chicago; Portland; and San Juan

10. Phoenix; Fresno; and Yuma

11. Tucson; Boise; and San Diego

12. Denver; Western; MA; and Maine

13. South Shore, MA; Austin; and Lubbock

14. South Jersey; Fort Worth; and Los Angeles

15. Orange County; Dallas; and Sarasota

16. Houston; Peoria; and Livermore

THE CONTEST AND SALES REPRESENTATIVES. A Sales Representative who contributes (i) at least five (5) points to a specific Freedom Forever branch and (ii) such branch is also part of the winning Team, may be deemed a Contest winner and claim the associated Contest Prize (as defined below). A Sales Representative’s eligibility is solely subject to the Terms hereunder. 

CONTEST PRIZES. At the conclusion of the Contest Period, the top three performing Teams will be selected as the winners. The top three prizes are as follows:

(1) 1st place GOLD MEDAL prize*: Tickets to a cruise ship OR box seats to a professional sporting event. For only the first-place prize, eligible Contest participants are allowed to bring a plus one of their choosing (total ARV including a plus one: $700). 

(2) 2nd place SILVER MEDAL prize*: Tickets to a cruise ship OR box seats to a professional sporting event (ARV: $350 per ticket).

(3) 3rd place BRONZE MEDAL prize*: Box seats to a professional sporting event (ARV: $250 per ticket).

*Upon the conclusion of the Contest, the Host shall determine whether the 1st and 2nd place winners will go on a cruise or to a professional sporting event. All aspects of the prizes, including, without limitation, the venue, time, place, and location shall be determined in Host’s sole and absolute discretion. For example and for purposes of illustration only, the Gold Medal prize may be box seats at the Crypto Arena Stadium for all eligible Contest participants of the winning Team, with such date and time to be determined by Host. If an eligible Contest participant of the winning Team is unable to attend the event selected by Host, such participant shall forfeit the prize. All travel and other ancillary accommodations to and from the cruise and/or professional sporting event shall be arranged by the eligible Contest participant and at the eligible Contest participant’s sole cost and expense.

Hidden Prizes. Additionally, other prizes have been hidden and will be redeemable during the Contest Period(the “Hidden Prize(s)”). These Hidden Prizes can be unlocked and claimed as eligible Contest participants download VOLT and create a unique VOLT account, and hit certain sales milestones by submitting eligible entries through VOLT. All prizes, including the first, second, and third contest prizes and Hidden Prizes, are collectively referred to as the “Contest Prize(s).”

CONTEST POINT SYSTEM. During the Contest Period, each Team and Sales Representative can earn points by achieving objectives. The VOLT app will host a Contest leaderboard that will be updated daily, displaying the progress and total points earned for each Team.

The objectives and their corresponding point values are set forth as follows:

• For each lead closed = 1 point**

• For each deal closed = 1 point**

• For each solar system that reaches completed installation = 3 points***

• For every five (5) star Google review obtained = 5 points****

The Host reserves the right to remove or amend points for safety, quality, or customer satisfaction purposes.

**Only leads and deals originating from Clean Deals shall be counted. “Clean Deals” has the same meaning and requirements as set forth under the Freedom Forever Clean Deals criteria, as provided to Freedom Forever’s independent authorized dealers and contracted sales representatives.

***Completed installation means that the System has been fully installed and is either awaiting PTO or has already reached PTO. Moreover, additional points may be awarded for installed Systems that are larger in system size.

****All Google reviews must be obtained in strict compliance with the guidelines set forth in the below section titled “GUIDELINES FOR OBTAINING CUSTOMER REVIEWS.”    

HOW TO ENTER. To enter the Contest, you must download VOLT, create a unique VOLT account, turn on “Allow Location Access”, and submit all eligible Contest submissions through the app. Only entries submitted through VOLT will be counted. Entries cannot be combined or shared between Contest participants. Sharing your VOLT account or your VOLT login will result in disqualification from the Contest. Entry to the Contest isavailable only to the employees of Freedom Forever and the Sales Representatives. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in this Contest. The Host reserves the right to verify any information and any submissions before an entry is considered eligible.  

ALTERNATE METHOD OF ENTRY. Eligible individuals may also enter the Contest for the chance to win a Hidden Prize by sending an email to brand@freedomforever.com during the Contest Period, including the following information: (i) full legal name, address, date of birth, phone number, and (ii) whether you are a Sales Representative or, if an employee of Freedom Forever, your stationed branch location and title at Freedom Forever. You may only enter once during the Contest Period. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.

CONTEST PERIOD. All entry submissions must be submitted to VOLT, starting December 20, 2023, 12:00 am and ending February 10, 2024, 11:00 pm. The time zone that will apply for the Contest Period shall be the geographic region in which the eligible entry is submitted. For illustration purposes only, if a deal is closed for aproperty situated in California, then the Pacific time zone shall apply for the submitted entry.

ELIGIBILITY. The Contest is subject to all applicable federal, state, and local laws and is only open to residents of the United States. Only employees of Freedom Forever who have been employed with the company for a minimum of half the duration of the Contest Period and are in good standing at the time the prizes are awarded may be eligible to participate and win this Contest. Sales Representatives must be in good standing with both Freedom Forever and their respective Freedom Forever authorized dealer, at the time the prizes are awarded, to be eligible to participate and win this Contest. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in this Contest. The Contest participant must be at least eighteen (18) years of age and reside within one of the 50 United States, the District of Columbia, or Puerto Rico. This Contest is void where prohibited by law.

RIGHTS OF THE HOST. The Host reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest for causes beyond the Host’s control or other causes that affect the administration, security, and or proper conduct of the Contest. The Host reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest, the website,VOLT mobile app, or who violates these terms and conditions.  

RELEASE AND LIMITATIONS OF LIABILITY.  By entering this Contest, you agree not to assert any claims or causes of action against the Host, its successors, assigns, or subsidiaries, and any of their members, directors, assignees, officers, employees, agents and representatives (“Released Parties”) and agree to indemnify and hold harmless the Released Parties from any liability arising out of the submissions in violation of the representations and warranties contained herein and from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, arising or related to your entry or the acceptance, receipt, use, or misuse of any prize.  

The Released Parties are not responsible for, and will not have any liability in connection with, (a) any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize; (b) late, lost, delayed, illegible, damaged, corrupted or incomplete entries; (c) incorrect or inaccurate capture of, damage to, or loss of entries or entry information; or (d) any other human, mechanical or technical error of any kind relating to the operation of any attempted communications with any entrant, the submission, collection, storage and/or processing of entries, or the administration of the Contest.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE HOST, OR ITS SUCCESSOR, ASSIGNS OR ANY OF THEIR MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE CONTEST, TO THE MAXIMUM EXTENT PERMITTED BY LAW. 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

For California Employees: You agree that you have read and expressly waive the following provisions of California Civil Code, Section 1542:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

CONTEST WINNER SELECTION. Hidden Prizes will be redeemable as valid entries are counted during the Contest Period. The Host will notify you through the VOLT app when you have unlocked a Hidden Prize. The top three (3) Teams will be selected at the conclusion of the Contest Period and be awarded the prizes associated with the first, second, and third place prizes. 

WINNER NOTIFICATION. The three (3) winning Teams will be announced within ten (10) business days from the conclusion of the Contest Period. If you are part of the winning Teams, you will be notified by email within seven (7) business days following the determination. The Host shall have no liability for a winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information or account. To remain eligible for a prize, a winner must respond to Host’s email within five (5) days after being contacted. If a winner cannot be contacted or fails to claim the prize within five (5) days from the time award notification was sent, the prize may be forfeited, and an alternate winner may be selected. The Host may require, in its sole discretion, a winner to complete, sign, and return to the Host an Affidavit of Eligibility, Release of Liability, IRS Form-1099, and/or any other requested documents. An entry is valid when it complies with all the terms and conditions of this Contest.

MISCELLANEOUS PROVISIONS. Entrants agree that the decisions of the Host related to the Contest are final and binding in all matters. The Host reserves the right to suspend, cancel, terminate or modify the Contest without advance notice or to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions, as Host shall deem reasonable under the circumstances. No substitution, request for the cash equivalent, or transfer of the right to receive the Contest Prizes is permitted, except in the sole discretion of Host, which has the right to substitute any prize with another prize of equal or greater value. The prizes areawarded “as-is” and without any warranty, guaranty, or representation of any kind, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose, durability, reliability, and/or performance.  Any issues, claims, or questions regarding the use or condition of the prize items should be directed at the appropriate manufacturers of the items.

THIRD-PARTY TRADEMARK. The use of any third-party trademark is for the purpose of prize description only and such use is not intended to suggest or imply sponsorship, endorsement, affiliation, or the approval of this Contest.

TAXES. The Host shall cover the purchase taxes for all Contest Prizes. It is the sole responsibility of the winner(s) to pay all other federal, state, local, and foreign taxes in connection with a Contest Prize, if any. Any prizes valued at more than $600 will require the Host to issue an IRS Form-1099 to the winning entrant, for the prize’s fair market value. Completion and submission of this IRS Form-1099 to Host is a condition precedent to receiving any prize.

DISPUTES. THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with the Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Riverside County, California. YOU ACKNOWLEDGE AND AGREE TO HEREBY WAIVE AND RELEASE ANY RIGHT TO BRING ANY DISPUTE ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY AS A CLASS ACTION OR PARTICIPATE IN THE SAME.

PRIVACY POLICY. Personal information supplied in connection with the Contest is subject to applicable data protection laws and Host’s Privacy Policy at https://freedomforever.com/privacy-policy/ and https://freedomforever.com/privacy-notice-for-california-residents/ for California residents. By entering thisContest, entrants acknowledge that they have read the Host’s Privacy Policy and hereby agree to the Host’s collection and use of their personal information in accordance with such laws and Privacy Policy.

RIGHTS GRANTED BY YOU. By submitting your entry (e.g., photograph, etc.), you understand and agree that the Host and anyone acting on its behalf, its successors and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, address (city and state), likeness, picture, opinion, statements, and/or other information and content provided and/or obtained in connection with the Contest for any purpose, including but not limited to, promotion, trade, commerce, advertising, or publicity, without notice, review or approval by you, and without additional compensation, except where prohibited by law. All entries for the Contest are the property of the Host.

SOME JURISDICTIONS DO NOT ALLOW THE RECEIPT OF A PRIZE TO BE CONTINGENT ON THE ABOVE GRANTING OF PUBLICITY RIGHTS, SO THE ABOVE MAY NOT APPLY TO YOU. RESIDENTS OF THESE JURISDICTIONS HAVE THE RIGHT TO OPT OUT OF THIS PROVISION.

NAME OF WINNER(S).  To obtain the name of the winner(s) of this Contest after the drawing, please contact the Host by emailing brand@freedomforever.com.

GUIDELINES FOR OBTAINING CUSTOMER REVIEWS. Businesses are not allowed to offer incentives in exchange for reviews, and all eligible Contest participants must refrain from offering the customer any type of incentive in exchange for a positive review on Google. Any violation by a Contest participant of these guidelines may result in disqualification from the Contest and/or removal of any Contest points earned.

From Google: “Reviews should represent the genuine experience of the user and should not be written by someone with a conflict of interest.”

 Review gating is prohibited! Contest participants should not discourage or prohibit negative reviews or selectively solicit positive reviews from customers. All customers should be given an equal opportunity to leave their feedback.

  • E.g., filtering a customer contact list to only show positive reviews, then asking only those customers to leave a review on Google.

• Contest participants must not encourage, solicit, or otherwise permit the posting of fake and unacceptable reviews, including reviews written by someone:

  • Who has not used our services (e.g., no existing contract with Freedom Forever)
  • Who is paid to write a review
  • Who is affiliated with the Contest participant (e.g., friends, family, other employees, etc.)

• Contest participants should not incentivize reviews by offering the following:

  • Money
  • Gifts
  • Discounts
  • Free goods or services

• Reviews should not be written by those with a conflict of interest, including:

  • Someone who is or is associated with the business owner
  • Competitors of the business or their employees
  • Someone who has a financial interest in Freedom Forever

• Google does not allow content from accounts pretending to be someone else (aka falsely using a customer’s name to create a fake account).

Reviews should only be solicited from customers of that specific Freedom Forever branch. Customers who received services from different branch locations should not leave reviews for other branches.
