Give Freedom Terms and Conditions

Give Freedom (“Give Freedom”) is a charitable initiative hosted by Freedom Forever LLC and GivePower Foundation, a Delaware non-profit corporation (the “Hosts”). The objective of Give Freedom is to provide solar energy options to individuals and communities with limited energy resources at no cost. By submitting your entries through Freedom Forever’s mobile app, “VOLT”, you acknowledge that you have read, reviewed, accepted, and agreed to be bound by these Terms and Conditions, VOLT’s privacy policy and terms and conditions (viewable in the VOLT app), and by the Host’s decisions, which are final and binding. You also confirm that you are (i) either an employee of Freedom Forever or a contracted sales representative of an independent authorized dealer of Freedom Forever (hereinafter individually and collectively, the “Participant(s)”), (ii) are at least eighteen (18) years old, and (iii) live within the United States. Give Freedom is subject to federal, state, municipal, and local laws and regulations and is void where prohibited or restricted by law. Your participation in Give Freedom is voluntary. Winning a prize is contingent upon fulfilling all requirements set forth herein.

DATES. Give Freedom will commence at 12:00 A.M. PST on August 5, 2024, and conclude at 11:59 P.M. PST on November 10th, 2024 (the “Give Freedom Period”).

THE INITIATIVE. During the Give Freedom Period, a Participant has the opportunity to contribute a portion of money earned on a sale to Give Freedom (the “Adder”). The Adder is not required and is solely at the option of the Participant. The Adder options are as follows*:

· One (1) cent ($0.01) per Watt

· Five (5) cents ($0.05) per Watt

· Ten (10) cents ($0.10) per Watt

· Twenty (20) cents ($0.20) per Watt

*Participants may opt to choose their Adder amount. For illustration purposes only, a Participant may choose to contribute twenty-five (25) cents ($0.25) as their Adder on a sale.

In exchange for a Participant’s Adder, they are eligible to receive various prizes. See “Prizes” below for more information.

The top Participants who contributed the highest total Adder amount during the Give Freedom Period will be chosen to join the Hosts on a volunteer trip. See “Team Trek” below for more information.

In addition to the prizes mentioned above, when a Participant chooses an Adder, they have the option to submit a household to win a free Freedom Forever solar system. Participants may submit a household each time they choose an Adder. A Participant may only nominate a household once. For illustration purposes only, a Participant may submit household A to win a free Freedom Forever solar system in one Adder, and household B in the next Adder; however, they may not submit either household A or B more than once. At the conclusion of the Give Freedom Period, Freedom Forever

will select the winner of the free Freedom Forever solar system from the households submitted by Participants. Submitting a household is entirely voluntary and Participants are not required to submit a household when choosing an Adder. There is no prize associated with submitting a household. For the avoidance of doubt, if a household that a Participant submitted is ultimately selected to receive the free Freedom Forever solar system, the Participant does not receive any consideration.

PRIZES. During the Give Freedom Period, Participants earn one (1) point for every cent ($0.01) per Watt contributed in their Adder.

The following prizes will be awarded at the conclusion of the Give Freedom Period. Each prize may only be won once by a qualifying Give Freedom Participant.

· Five (5) Points: A Freedom Forever-branded t-shirt (ARV: $12.00).

· Ten (10) Points: A Freedom Forever-branded hat (ARV: $12.00).

· Twenty (20) Points: A Freedom Forever-branded water bottle and journal (ARV for the water bottle: $48.00; ARV for the journal: $12.00; Total ARV: $60.00).

· Thirty (30) Points: A Freedom Forever-branded sweatshirt (ARV: $22.00).

· Fifty (50) Points: A custom Freedom Forever-branded jersey (ARV: $32.00).

For illustration purposes only, a Participant with sixty (60) points at the conclusion of the Give Freedom Period will receive (1) a Freedom Forever-branded t-shirt; (2) a Freedom Forever-branded hat; (3) a Freedom Forever-branded water bottle and journal; (4) a Freedom Forever-branded sweatshirt; and (5) a custom Freedom Forever-branded jersey.

The Hosts reserve the right to verify, remove or amend points for safety, quality, or customer satisfaction purposes. The Hosts reserve the right to remove or amend a Participant’s points if the Hosts determine that he/she has violated any of the Give Freedom rules. Any and all determinations made by Hosts hereunder are in their sole and absolute discretion.

TEAM TREK. In addition to the prizes above, during August, September, and October, the top three (3) Participants who contributed the highest total Adder amounts to Give Freedom during each month will be selected to join the Hosts on a volunteer trip to install a solar system in a remote community in need of solar energy (“Team Trek”). For the avoidance of doubt, there will be three (3) top Participants selected at the end of August, three (3) top Participants selected at the end of September, and three (3) top Participants selected at the end of October, for a total of nine (9) Participants. All nine (9) Participants will have the opportunity to join one Team Trek. Participants may only be chosen as a top contributor once. For illustration purposes only, a Participant who is chosen as one of the top Give Freedom contributors for August may not be selected again as a top contributor for September or October. The date of the Team Trek is pending and subject to change. The Team Trek includes each Participant’s destination location transportation, meals, and lodging. Additional Team Trek details (e.g., dates, airfare, community selection, etc.) are pending and subject to change. Participation in the Team Trek is entirely optional, and Participants selected to join the Team Trek are permitted to decline at their discretion.

HOW TO PARTICIPATE. To participate in Give Freedom, you must download VOLT, create a unique VOLT account, turn on “Allow Location Access”, and submit all eligible Give Freedom submissions through the app. Only entries submitted through VOLT will be counted. Entries cannot be combined or shared between Give Freedom Participants. Sharing your VOLT account or your VOLT login will result in disqualification from Give Freedom. Entry is available only to the employees of Freedom Forever and the Give Freedom Participants. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in Give Freedom. The Hosts reserve the right to verify any information and any submissions before an entry is considered eligible.

ALTERNATE METHOD OF PARTICIPATION. Eligible individuals may also participate in Give Freedom for the chance to win a prize by sending an email to brand@freedomforever.com during the Give Freedom Period, including the following information: (i) full legal name, address, date of birth, phone number, and (ii) whether you are a Give Freedom Participant or, if an employee of Freedom Forever, your stationed branch location and title at Freedom Forever. Eligible individuals may only enter Give Freedom once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.

GIVE FREEDOM PERIOD. All entry submissions must be submitted to VOLT, starting August 5, 2024, 12:00 am and ending November 10, 2024, 11:59 pm. The time zone that will apply for the Give Freedom Period shall be the geographic region in which the eligible entry is submitted. For illustration purposes only, if a deal is closed for a property situated in California, then the Pacific time zone shall apply for the submitted entry.

ELIGIBILITY. Give Freedom is subject to all applicable federal, state, and local laws and is only open to residents of the United States. Only employees of Freedom Forever who have been employed with the company for a minimum of half the duration of the Give Freedom Period and are still employed with Freedom Forever and in good standing at the time the prizes are awarded may be eligible to participate and win. Give Freedom Participants must be in good standing with both Freedom Forever and their respective Freedom Forever authorized dealer, at the time the prizes are awarded, to be eligible to participate and win. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in Give Freedom. Give Freedom Participants must be at least eighteen (18) years of age and reside within one of the 50 United States, the District of Columbia, or Puerto Rico. Give Freedom is void where prohibited by law.

RIGHTS OF THE HOSTS. The Hosts reserve the right, in their sole discretion, to cancel, terminate, modify, or suspend Give Freedom for causes beyond the Hosts’ control or other causes that affect the administration, security, and or proper conduct of Give Freedom. The Hosts reserve the right, in their sole and absolute discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of Give Freedom, the website, VOLT mobile app, or who violates these terms and conditions.

RELEASE AND LIMITATIONS OF LIABILITY. By participating in Give Freedom, you agree not to assert any claims or causes of action against the Hosts, their successors, assigns, or subsidiaries, and any of their members, directors, assignees, officers, employees, agents and representatives (hereinafter individually and collectively, the “Released Parties”) and agree to indemnify and hold

harmless the Released Parties from any liability arising out of the submissions in violation of the representations and warranties contained herein and from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, arising or related to your entry or the acceptance, receipt, use, or misuse of any prize.

The Released Parties are not responsible for, and will not have any liability in connection with, (a) any typographical or other error in the printing of the offer, administration of Give Freedom or in the announcement of prizes; (b) late, lost, delayed, illegible, damaged, corrupted or incomplete entries; (c) incorrect or inaccurate capture of, damage to, or loss of entries or entry information; or (d) any other human, mechanical or technical error of any kind relating to the operation of any attempted communications with any entrant, the submission, collection, storage and/or processing of entries, or the administration of Give Freedom.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE HOSTS, OR THEIR SUCCESSOR, ASSIGNS OR ANY OF THEIR MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE GIVE FREEDOM, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

For California Employees: You agree that you have read and expressly waive the following provisions of California Civil Code, Section 1542:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

GIVE FREEDOM WINNER SELECTION. At the conclusion of the Give Freedom Period, Participants will be awarded the prizes associated with their total points earned. See “Prizes” for more information. Additionally, the nine (9) Participants selected to join the Team Trek will be notified by the Hosts of their selection and provided with relevant details concerning the Team Trek. See “Team Trek” for more information.

WINNER NOTIFICATION. If you are one of the Give Freedom winners, you will be notified by email within seven (7) business days following the determination. The Hosts shall have no liability for a winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information or account. To remain eligible for a prize, a winner must respond to Host’s email within seven (7) days after being contacted. If a winner cannot be contacted or fails to claim the prize within seven (7) days from the time award notification was sent, the prize may be forfeited, and an alternate winner may be selected. The Hosts may require, in their sole discretion, a winner to complete, sign, and return to the Hosts an Affidavit of Eligibility, Release of Liability, IRS Form-1099, and/or any other requested documents. If such documents are requested by the Hosts, then a winner’s receipt of the prizes is

strictly subject to such winner’s completion and return of the required documents. Failure to timely return any required Hosts documents may result in forfeiture of prizes. An entry is valid when it complies with all the terms and conditions of Give Freedom.

MISCELLANEOUS PROVISIONS. Entrants agree that the decisions of the Hosts related to Give Freedom are final and binding in all matters. The Hosts reserve the right to suspend, cancel, terminate or modify Give Freedom without advance notice or to re-commence Give Freedom, if at all, only at such time(s) and upon such terms and conditions, as Hosts shall deem reasonable under the circumstances. No substitution, request for the cash equivalent, or transfer of the right to receive Give Freedom prizes is permitted, except in the sole discretion of Hosts, which has the right to substitute any prize with another prize of equal or greater value. The prizes are awarded “as-is” and without any warranty, guaranty, or representation of any kind, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose, durability, reliability, and/or performance. Any issues, claims, or questions regarding the use or condition of the prize items should be directed at the appropriate manufacturers of the items.

THIRD-PARTY TRADEMARK. The use of any third-party trademark is for the purpose of prize description only and such use is not intended to suggest or imply sponsorship, endorsement, affiliation, or the approval of the Hosts or Give Freedom.

TAXES. Freedom Forever shall cover the purchase taxes for all Give Freedom prizes. It is the sole responsibility of the winner(s) to pay all other federal, state, local, and foreign taxes in connection with a Prize, if any. Any prizes valued at more than $600 will require the Freedom Forever to issue an IRS Form-1099 to the winning entrant, for the prize’s fair market value. Completion and submission of this IRS Form-1099 to Freedom Forever is a condition precedent to receiving any prize.

DISPUTES. GIVE FREEDOM IS GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in Give Freedom, Participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with Give Freedom, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Riverside County, California. YOU ACKNOWLEDGE AND AGREE TO HEREBY WAIVE AND RELEASE ANY RIGHT TO BRING ANY DISPUTE ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY AS A CLASS ACTION OR PARTICIPATE IN THE SAME.

PRIVACY POLICY. Personal information supplied in connection with Give Freedom is subject to applicable data protection laws and Freedom Forever’s Privacy Policy at https://freedomforever.com/privacy-policy/ and https://freedomforever.com/privacy-notice-for-california-residents/ for California residents. By participating in Give Freedom, entrants acknowledge that they have read the Freedom Forever’s Privacy Policy and hereby agree to the Hosts’ collection and use of their personal information in accordance with such laws and Privacy Policy.

RIGHTS GRANTED BY YOU. By submitting your entry (e.g., photograph, etc.), you understand and agree that the Hosts and anyone acting on its behalf, its successors and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your

entry, name, address (city and state), likeness, picture, opinion, statements, and/or other information and content provided and/or obtained in connection with Give Freedom for any purpose, including but not limited to, promotion, trade, commerce, advertising, or publicity, without notice, review or approval by you, and without additional compensation, except where prohibited by law. All entries for Give Freedom are the property of the Hosts.

SOME JURISDICTIONS DO NOT ALLOW THE RECEIPT OF A PRIZE TO BE CONTINGENT ON THE ABOVE GRANTING OF PUBLICITY RIGHTS, SO THE ABOVE MAY NOT APPLY TO YOU. RESIDENTS OF THESE JURISDICTIONS HAVE THE RIGHT TO OPT OUT OF THIS PROVISION.

The proceeds from the promotion will benefit GivePower Foundation, located at 415 East St. Elmo, Suite #1-F1, Austin, TX 78746, a 501(c)(3) charity. Donations are tax deductible by Freedom Forever.
