Official Rules for the 2025 Labor Day BBQ Giveaway at Costello’s Ace Hardware Locations

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

These Official Rules apply to the 2025 Labor Day BBQ Giveaway at the participating Costello’s Ace Hardware locations (the “Giveaway”). By participating in the Giveaway, you acknowledge and agree you understand and accept the terms and conditions set forth in these Official Rules. You also confirm that you are at least eighteen (18) years old and live within the United States. The Giveaway is subject to federal, state, municipal, and local laws and regulations and is void where prohibited or restricted by law.

Sponsor. The Giveaway is sponsored by Freedom Forever LLC (the “Sponsor”).

Prizes. For this Giveaway, there will be one prize (the “Grand Prize”): a Wood Pellet Grill with an approximate retail value of Five Hundred and Ninety-Nine Dollars ($599.99).

No substitution, request for the cash equivalent, or transfer of the right to receive the Grand Prize is permitted, except in the sole and absolute discretion of the Sponsor, which has the right to substitute the Grand Prize with another prize of equal or greater value.

The Grand Prize is awarded by Sponsor “as is” and without any warranty, guarantee, or representation of any kind, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose, durability, reliability, and/or performance. Any issues, claims, or questions regarding the use or condition of the Grand Prize should be directed to the appropriate manufacturer(s) of the Grand Prize or its components.

Please note there is a limit of one entry per household. Sales Representative’s direct relatives and/or any shared household members are ineligible.

Eligibility. This Giveaway is open to anyone who, at the time of entry: (a) is at least eighteen (18) years of age; (b) is a homeowner of a residence in Maryland, New Jersey, or Pennsylvania, or an individual duly-authorized by such homeowner to participate in this Giveaway; and (c) has submitted an active email address.

Agreement to Official Rules. By entering the Giveaway, you indicate your full and unconditional agreement to, and acceptance of (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning the Grand Prize is contingent upon fulfilling all requirements set forth herein.

Entry Period. The Giveaway begins on August 29, 2025, at 9:00am EST and ends on September 1, 2025 7:00pm EST (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible for consideration in the Giveaway.

How to Enter. To enter the Giveaway, you must: (a) have personally received an offer to participate in the Giveaway from the Sponsor or a Freedom Forever-authorized sales representative leading up to or during the Entry Period; (b) schedule a home solar consultation (“energy analysis”) during the Entry Period noted above; and (c) complete a solar consultation by September 15, 2025. A “solar consultation” is defined as meeting with a Freedom Forever solar consultant to walk through a custom energy analysis.

The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.

Taxes. All federal, state and local taxes are the sole responsibility of the winner.

Drawing. On or about September 17, 2025, the Sponsor will select one (1) winner for the Grand Prize in a random drawing of all eligible entries received during the Entry Period. The odds of winning will depend on the number of eligible entries received.

Notification and Requirements of Potential Winners. The Sponsor will email the potential winner at the email address submitted in the Entry. The Sponsor will provide instructions on how to claim the prize via such email. To remain eligible for the Grand Prize, the potential winner must respond to the email within forty-eight (48) hours after being contacted by the Sponsor. Sponsor is not responsible or liable if the potential winner cannot be contacted for any reason whatsoever following reasonable efforts by Sponsor to contact the potential winner.

The potential winner must meet all eligibility requirements and fully comply with these Official Rules. Sponsor may in its discretion require the potential winner to complete, sign, and return to Sponsor an Affidavit of Eligibility, Release of Liability, 1099, and/or any other requested documents.

If a potential winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept the prize, fails to respond to a winner notification within forty-eight (48) hours, fails to sign and return all requested documents within the timeframe specified by Sponsor, or otherwise fails to fulfill any of Sponsor’s conditions for claiming the prize, the Grand Prize may be forfeited. If the Grand Prize is forfeited for a potential winner for any reason, it may be awarded to an alternate potential winner, at the Sponsor’s sole discretion, selected at random from the remaining pool of eligible entries received during the Entry Period.

To receive the Grand Prize, the potential winner must satisfy all the aforementioned requirements. Sponsor will have the Grand Prize ready for pickup at the participating Costello’s Ace Hardware

store. Unless otherwise agreed to by Sponsor, the selected winner must pick up the Grand Prize within forty-eight (48) hours of receipt of Sponsor’s instructions on how to claim the Grand Prize.

Sponsor’s Sole Discretion. Sponsor reserves the right, in its sole discretion, to change the rules of the Giveaway at any time and if, for any reason, the Giveaway is not capable of running as planned, to cancel, terminate, modify, or suspend the Giveaway. Any and all decisions of the Sponsor related to the Giveaway are final and made at Sponsor’s sole discretion.

Grant of Rights. By participating in this Giveaway, each entrant grants to the Sponsor, and its subsidiaries, affiliates, agents, employees, assigns, and successors (collectively, “Sponsor Affiliates”) the perpetual right to use entrant’s name, social media user name and/or handle, address (city and state), biographical information, likeness, picture, voice, opinions, and other information and content provided and/or obtained in connection with the Giveaway for promotion, trade, commercial, advertising, publicity, or any other purposes without notice, review or approval and without additional compensation, except where prohibited by law. All entries for the Giveaway are the property of Sponsor.

Photo Release Consent: By participating in this Giveaway, I grant Sponsor permission to use my photo(s) taken in connection with this Giveaway for promotional purposes. This includes, but is not limited to, use on social media, websites, and other marketing materials. I understand that these images may be used without further notice or compensation, and I waive any rights to inspect or approve the final content.

Release and Limitations of Liability. By participating in the Giveaway, to the fullest extent permitted by applicable law, you agree to release and hold harmless Sponsor and Sponsor Affiliates (collectively, the “Released Parties”) from and against any claim or cause of action arising out of or relating to your participation in the Giveaway, the receipt or use of the prize, or any exercise by the Released Parties of the rights identified in the “Grant of Rights” or “Photo Release Consent” sections above, including without any limitation, any and all claims and causes of action: (a) relating to any personal injury, death or property damage or loss sustained by any entrant or any other person, (b) based upon any allegation of violation of the right of privacy or publicity, misappropriation, defamation, or violation of any other personal or proprietary right, (c) based upon any allegation of infringement of copyright, trademark, trade dress, patent, trade secrets, or any intellectual property right, or (d) based upon any allegation of a violation of the laws, rules or regulations relating to personal information and data security. You agree not to assert any such claim(s) or cause(s) of action against any of the Released Parties and waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Further, in no event shall the Released Parties be liable for any attorney’s fees. Each entrant assumes the risk of, and all liability for, any injury, loss or damage caused, or claimed to be caused, by participation in this Giveaway or the provision, acceptance or use of the Grand Prize.

The Released Parties are not responsible for, and will not have any liability in connection with, (a) any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prize; (b) late, lost, delayed, illegible, damaged, corrupted or incomplete entries; (c) incorrect or inaccurate capture of, damage to, or loss of entries or entry information; or (d) any other human, mechanical or technical error of any kind relating to the operation of communications or attempted communications with any entrant, the submission, collection, storage and/or processing of entries, or the administration of the Giveaway.

Choice of Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Sponsor or any entrant in connection with the Giveaway shall be governed by, and construed in accordance with, the substantive laws of the State of California. YOU ACKNOWLEDGE AND AGREE TO HEREBY WAIVE AND RELEASE ANY RIGHT TO BRING ANY DISPUTE ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY AS A CLASS ACTION OR PARTICIPATE IN THE SAME.

Privacy Policy. Personal information supplied in connection with the Giveaway is subject to applicable data protection laws and Sponsor’s Privacy Policy at https://freedomforever.com/privacy-policy/ and https://freedomforever.com/privacy-notice-for-california-residents/ for California residents. By entering the Giveaway, entrants acknowledge that they have read Sponsor’s Privacy Policy and hereby agree to Sponsor’s collection and use of their personal information in accordance with such laws and Privacy Policy.

Third-Party Trademark. The use of any third-party trademark is for the purpose of prize description only and such use is not intended to suggest or imply sponsorship, endorsement, affiliation, or the approval of this Giveaway.
