Fall Brawl 2024 Terms and Conditions

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

The Fall Brawl 2024 (“Contest”) is a sales competition hosted by Freedom Forever LLC (the “Host”). By submitting your entries through Freedom Forever’s mobile app, “VOLT”, you acknowledge that you have read, reviewed, accepted, and agreed to be bound by these Terms and Conditions, VOLT’s privacy policy and terms and conditions (viewable in the VOLT app), and by the Host’s decisions, which are final and binding. You also confirm that you are (i) either an employee of Freedom Forever or a contracted sales representative of an independent authorized dealer of Freedom Forever (hereinafter individually and collectively, the “Contest Participant(s)”), (ii) are at least eighteen (18) years old, and (iii) live within the United States. This Contest is subject to federal, state, municipal, and local laws and regulations and is void where prohibited or restricted by law. Your participation in this Contest is voluntary. Winning a prize is contingent upon fulfilling all requirements set forth herein.

THE CONTEST. The Contest will commence on October 13, 2024, and will conclude on a date to be determined by the Host (the “Contest Period”). The date on which the Contest concludes will be disclosed to Contest Participants prior to said date. The Contest consists of ten (10) rounds (“Round(s)”). During each Round of the Contest, a specified number of winners will be selected at the conclusion of each Round (see “Contest Prizes”). The winners are selected based upon their individual point totals, with the highest point earners being selected as winners.  

CONTEST PRIZES. The following prizes are associated with each Round of the Contest Period. Each prize may only be won once by a qualifying Contest Participant.

• Round 1: A custom Host-branded jersey (ARV: $80.00). There will be five hundred and twelve (512) winners selected at the conclusion of Round 1 (October 19, 2024).
• Round 2:  A one-hundred-dollar ($100.00) Freedom Forever Store gift card (ARV: $100.00). There will be two hundred and fifty-six (256) winners selected at the conclusion of Round 2 (October 26, 2024).
• Round 3: A custom Host-branded Timbuk2 backpack (ARV: $156.25). There will be one hundred and twenty-eight (128) winners selected at the conclusion of Round 3 (November 2, 2024).
• Round 4: A North Face jacket (ARV: $330.00). The specific style of the jacket shall be determined solely at the discretion of the Host. There will be sixty-four (64) winners selected at the conclusion of Round 4 (November 9, 2024).
• Round 5: A Nintendo Switch – OLED Model (ARV: $350.00). There will be thirty-two (32) winners selected at the conclusion of Round 5 (November 16, 2024).
• Round 6: An Apple Watch (Series 10) (ARV: $400.00). There will be sixteen (16) winners selected at the conclusion of Round 6 (November 23, 2024).
• Round 7: An iPhone 16 Pro (ARV: $1,099.00). There will be eight (8) winners selected at the conclusion of Round 7 (November 30, 2024).
• Round 8: A MacBook Air (ARV: $1,299.00). There will be four (4) winners selected at the conclusion of Round 8 (December 7, 2024).

*All travel and other ancillary accommodations to and from Super Bowl LIX shall be arranged by the eligible Contest Participant and at the eligible Contest Participant’s sole cost and expense.

All Contest Prizes will be distributed to Contest Participants after the Contest has concluded.

CONTEST POINT SYSTEM. During the Contest Period, the VOLT app will host a Contest leaderboard that will be updated in real-time, displaying the progress and total points earned for each Contest Participant. Contest Participants can earn points by achieving the following objectives:

• For each appointment set = 1 point**
• For each deal closed = 1 point**

**Only leads and deals that are properly and accurately submitted to the VOLT app will be counted. 

For the first eight Rounds of the Contest, each Contest Participant’s point total will roll over into the next Round. For illustration purposes only, if a Contest Participant accumulates three (3) points during Round 1, they will begin Round 2 with three (3) points. At the conclusion of Round 8, the point total will no longer roll over but instead, reset at the start of Rounds 9 and 10 respectively. The Contest Participant who earns the most points during Round 9 will win the Round 9 prize. The Contest Participant who earns the most points during Round 10 will win the Grand Prize.

The Host reserves the right to verify, remove, or amend points for safety, quality, or customer satisfaction purposes. The Host reserves the right to remove or amend a Contest Participant’s points if the Host determines that he/she has violated any of the Contest rules. Any and all determinations made by the Host hereunder are in its sole and absolute discretion.

EXTRA POINT OPPORTUNITY. In addition to earning points through appointment setting and deal closing (See “Contest Point System”), Contest Participants have the opportunity to earn additional points when they donate to Give Freedom, the Host’s charitable initiative. For every $0.10 donated to Give Freedom upon the closure of a deal, Contest Participants will receive an extra half (0.5) point. Additionally, a Contest Participant who originally sets an appointment that ultimately results in a deal with a donation to Give Freedom will also earn half (0.5) a point. For illustration purposes only, if a Contest Participant closes a deal and chooses to donate $0.10 to Give Freedom, they will earn a total of one and a half (1.5) points (one (1) point for closing the deal and half (0.5) a point for the donation), and the Contest Participant who originally set the appointment will also receive one and a half (1.5) points (one (1) point for setting the appointment and half (0.5) a point for the donation).  

For the avoidance of doubt, if a Contest Participant self-generates a deal, meaning they set the appointment and then proceed to close the deal and donate to Give Freedom, they will receive a total of three (3) points (one (1) point for setting the appointment and one (1) point for closing the deal, plus an additional one (1) point for the donation to Give Freedom (0.5 for setting and 0.5 for closing)).  

HOW TO ENTER. To enter the Contest, you must download VOLT, create a unique VOLT account, turn on “Allow Location Access”, and submit all eligible Contest submissions through the app. Only entries submitted through VOLT will be counted. Entries cannot be combined or shared between Contest Participants. Sharing your VOLT account or your VOLT login will result in disqualification from the Contest. Entry to the Contest is available only to the employees of Freedom Forever and the Contest Participants. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in this Contest. The Host reserves the right to verify any information and any submissions before an entry is considered eligible.

ALTERNATE METHOD OF ENTRY. Eligible individuals may also enter the Contest for the chance to win a prize by sending an email to brand@freedomforever.com during the Contest Period, including the following information: (i) full legal name, address, date of birth, phone number, and (ii) whether you are a Contest Participant or, if an employee of Freedom Forever, your stationed branch location and title at Freedom Forever. Eligible individuals must only enter the Contest once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.

CONTEST PERIOD. All entry submissions must be submitted to VOLT, starting October 13, 2024, 12:00 am and ending on a date to be determined by the Host. The date on which the Contest concludes will be disclosed to Contest Participants prior to said date. The time zone that will apply for the Contest Period shall be the geographic region in which the eligible entry is submitted. For illustration purposes only, if a deal is closed for a property situated in California, then the Pacific time zone shall apply for the submitted entry.

ELIGIBILITY. The Contest is subject to all applicable federal, state, and local laws and is only open to residents of the United States. Only employees of Freedom Forever who have been employed with the company for a minimum of half the duration of the Contest Period and are still employed with Freedom Forever and in good standing at the time the prizes are awarded may be eligible to participate and win this Contest. Contest Participants must be in good standing with both Freedom Forever and their respective Freedom Forever authorized dealer, at the time the prizes are awarded, to be eligible to participate and win this Contest. For the avoidance of doubt, employees of Bright Solar Marketing are precluded from participating in this Contest. The Contest Participant must be at least eighteen (18) years of age and reside within one of the 50 United States, the District of Columbia, or Puerto Rico. This Contest is void where prohibited by law.

RIGHTS OF THE HOST. The Host reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest for causes beyond the Host’s control or other causes that affect the administration, security, and or proper conduct of the Contest. The Host reserves the right, in its sole and absolute discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest, the website, VOLT mobile app, or who violates these terms and conditions. 

RELEASE AND LIMITATIONS OF LIABILITY.  By entering this Contest, you agree not to assert any claims or causes of action against the Host, its successors, assigns, or subsidiaries, and any of their members, directors, assignees, officers, employees, agents, and representatives (hereinafter individually and collectively, the “Released Parties”) and agree to indemnify and hold harmless the Released Parties from any liability arising out of the submissions in violation of the representations and warranties contained herein and from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, arising or related to your entry or the acceptance, receipt, use, or misuse of any prize. 

The Released Parties are not responsible for, and will not have any liability in connection with, (a) any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize; (b) late, lost, delayed, illegible, damaged, corrupted or incomplete entries; (c) incorrect or inaccurate capture of, damage to, or loss of entries or entry information; or (d) any other human, mechanical or technical error of any kind relating to the operation of any attempted communications with any entrant, the submission, collection, storage and/or processing of entries, or the administration of the Contest.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE HOST, OR ITS SUCCESSOR, ASSIGNS OR ANY OF THEIR MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE CONTEST, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

For California Employees: You agree that you have read and expressly waive the following provisions of California Civil Code, Section 1542:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

CONTEST WINNER SELECTION. At the conclusion of each Round of the Contest Period, a specified number of winners will be selected and be awarded the prizes associated with that Round of the Contest.

WINNER NOTIFICATION. At the conclusion of each Round, if you are one of the prize winners, you will be notified via email. The Host shall have no liability for a winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information or account. To remain eligible for a prize, a winner must respond to Host’s email within seven (7) business days after being contacted. If a winner cannot be contacted or fails to claim the prize within seven (7) business days from the time award notification was sent, the prize may be forfeited, and an alternate winner may be selected. The Host may require, in its sole discretion, a winner to complete, sign, and return to the Host an Affidavit of Eligibility, Release of Liability, IRS Form-1099, and/or any other requested documents. If such documents are requested by the Host, then a winner’s receipt of the prizes is strictly subject to such winner’s completion and return of the required documents. Failure to timely return any required Host documents may result in forfeiture of prizes. An entry is valid when it complies with all the terms and conditions of this Contest.

MISCELLANEOUS PROVISIONS. Entrants agree that the decisions of the Host related to the Contest are final and binding in all matters. The Host reserves the right to suspend, cancel, terminate or modify the Contest without advance notice or to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions, as Host shall deem reasonable under the circumstances. No substitution, request for the cash equivalent, or transfer of the right to receive the Contest Prizes is permitted, except in the sole discretion of Host, which has the right to substitute any prize with another prize of equal or greater value. The prizes are awarded “as-is” and without any warranty, guaranty, or representation of any kind, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose, durability, reliability, and/or performance.  Any issues, claims, or questions regarding the use or condition of the prize items should be directed at the appropriate manufacturers of the items.

THIRD-PARTY TRADEMARK. The use of any third-party trademark is for the purpose of prize description only and such use is not intended to suggest or imply sponsorship, endorsement, affiliation, or the approval of this Contest.

TAXES. The Host shall cover the purchase taxes for all Contest Prizes. It is the sole responsibility of the winner(s) to pay all other federal, state, local, and foreign taxes in connection with a Prize, if any. Any prizes valued at more than $600 will require the Host to issue an IRS Form-1099 to the winning entrant, for the prize’s fair market value. Completion and submission of this IRS Form-1099 to Host is a condition precedent to receiving any prize.

DISPUTES. THIS CONTEST IS GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, the Contest Participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with the Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Riverside County, California. YOU ACKNOWLEDGE AND AGREE TO HEREBY WAIVE AND RELEASE ANY RIGHT TO BRING ANY DISPUTE ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY AS A CLASS ACTION OR PARTICIPATE IN THE SAME.

PRIVACY POLICY. Personal information supplied in connection with the Contest is subject to applicable data protection laws and Host’s Privacy Policy at https://freedomforever.com/privacy-policy/ and https://freedomforever.com/privacy-notice-for-california-residents/ for California residents. By entering this Contest, entrants acknowledge that they have read the Host’s Privacy Policy and hereby agree to the Host’s collection and use of their personal information in accordance with such laws and Privacy Policy.

RIGHTS GRANTED BY YOU. By submitting your entry (e.g., photograph, etc.), you understand and agree that the Host and anyone acting on its behalf, its successors and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, address (city and state), likeness, picture, opinion, statements, and/or other information and content provided and/or obtained in connection with the Contest for any purpose, including but not limited to, promotion, trade, commerce, advertising, or publicity, without notice, review or approval by you, and without additional compensation, except where prohibited by law. All entries for the Contest are the property of the Host.

SOME JURISDICTIONS DO NOT ALLOW THE RECEIPT OF A PRIZE TO BE CONTINGENT ON THE ABOVE GRANTING OF PUBLICITY RIGHTS, SO THE ABOVE MAY NOT APPLY TO YOU. RESIDENTS OF THESE JURISDICTIONS HAVE THE RIGHT TO OPT OUT OF THIS PROVISION.
